This Privacy Policy describes how American Confectioners Ltd (“we”, “us”, or “our”) collects, uses, discloses, and protects information when you use our website, mobile applications for iOS and Android, and related services (together, the “Services”). By using the Services, you agree to this Privacy Policy. If you do not agree, please do not use the Services.

Privacy and data enquiries: info@americansweets.com (please include “Privacy” in the subject line)

For app store listings (including Google Play and the Apple App Store), this policy URL may be provided as the public privacy policy for our applications.

2. Scope

This policy applies to personal information processed through:

  • Our public websites and online storefronts;
  • Our mobile apps distributed on the Apple App Store, Google Play, and other channels we may use;
  • Customer support, marketing, and communications you receive from us in connection with the Services.

Our Services are intended for a general audience. They are not directed at children under 13 (or under 16 where a higher age applies under local law), and we do not knowingly collect personal information from children for those audiences. If you believe we have collected information from a child, please contact us and we will take appropriate steps to delete it.

3. Information we collect

Depending on how you use the Services, we may collect the following categories of information:

3.1 Information you provide

  • Account and profile: name, email address, phone number, password or authentication credentials (stored using industry-standard hashing where applicable), delivery and billing addresses, and preferences.
  • Transactions: order details, payment references, and customer service messages. Payment card details are typically collected and processed by our payment service providers; we do not store full card numbers on our servers.
  • Communications: content you send when you contact support or respond to surveys.

3.2 Information collected automatically

  • Device and app data: device type, operating system version, app version, language, IP address, and diagnostic logs.
  • Usage data: pages or screens viewed, features used, referring URLs, timestamps, and crash or error reports.
  • Approximate location: derived from IP address or device settings where needed for fraud prevention, compliance, or to show relevant content; we do not continuously track precise GPS location unless a feature you opt into clearly requires it and you grant permission.

3.3 Information from third parties

  • Payment processors, fraud prevention providers, delivery partners, and analytics or advertising partners, where permitted by law and our agreements with them.
  • If you sign in with Apple, Google, or another identity provider, we receive information that provider shares with us according to your settings.

4. How we use information

We use personal information for purposes including:

  • Providing, operating, and improving the Services;
  • Processing orders, payments, deliveries, and returns;
  • Authenticating accounts and securing the Services;
  • Customer support and responding to enquiries;
  • Analytics, product development, and debugging (including crash reporting);
  • Marketing and promotional communications where permitted, including measuring the effectiveness of campaigns;
  • Legal compliance, enforcing our terms, and protecting rights, safety, and property;
  • Aggregated or de-identified analytics that do not identify you.

Where the UK GDPR or EU GDPR applies, we rely on legal bases such as: performance of a contract, legitimate interests (balanced against your rights), consent where required, and legal obligation.

5. Push notifications and marketing

If our apps offer push notifications, we will only send them where allowed by your device settings and applicable law. You can disable notifications in your device settings at any time. You may opt out of marketing emails by using the unsubscribe link in those messages, subject to transactional or legal notices we must send.

6. Cookies and similar technologies (web)

Our websites may use cookies, local storage, pixels, and similar technologies for essential operation, preferences, analytics, and (where permitted) advertising. You can control many cookies through your browser settings. Some features may not work if you disable essential cookies.

7. Sharing of information

We may share personal information with:

  • Service providers who assist us with hosting, payments, fraud prevention, shipping, email delivery, analytics, customer support tools, and app distribution platforms;
  • Professional advisers (lawyers, accountants) where necessary;
  • Authorities or third parties when required by law, court order, or to protect our legitimate interests in accordance with applicable law;
  • Business transfers in connection with a merger, acquisition, or sale of assets, subject to appropriate safeguards.

We do not sell your personal information for money. Where US state laws define “sale” or “sharing” more broadly (for example, certain digital advertising), we will honour applicable opt-out rights as required.

8. International transfers

We are based in the United Kingdom. If we transfer personal information to countries not recognised as providing adequate protection, we use appropriate safeguards such as standard contractual clauses approved by relevant authorities, where required.

9. Retention

We retain personal information only as long as necessary for the purposes described in this policy, including to satisfy legal, accounting, or reporting requirements. Retention periods vary depending on the nature of the data and legal obligations.

10. Security

We implement technical and organisational measures designed to protect personal information against unauthorised access, loss, or alteration. No method of transmission or storage is completely secure; we encourage you to use strong passwords and protect your devices.

11. Your rights and choices

Depending on your location, you may have rights to:

  • Access, correct, update, or delete certain personal information;
  • Object to or restrict certain processing;
  • Withdraw consent where processing is based on consent;
  • Data portability where applicable;
  • Lodge a complaint with a supervisory authority (for example, the ICO in the UK).

To exercise these rights, contact us using the details in Section 1 (email info@americansweets.com). We may need to verify your identity before responding.

For self-service options where available in our apps or website, see Delete account and Delete data.

12. California residents (CCPA / CPRA)

If you are a California resident, you may have additional rights under the California Consumer Privacy Act, including to know, delete, and correct personal information, and to opt out of certain “sales” or “sharing” as defined by California law. We will not discriminate against you for exercising these rights. To submit a request, email info@americansweets.com with “California Privacy Rights” in the subject line.

13. Apple App Store and Google Play

When you download our apps, Apple or Google may collect information in accordance with their own privacy policies. Our apps may request permissions (for example, notifications or camera for barcode scanning) only when needed for a clear feature; you can manage permissions in your device settings. In-app purchases and subscriptions may be processed by Apple or Google; their terms and privacy notices apply to those transactions.

14. Changes to this policy

We may update this Privacy Policy from time to time. We will post the updated version on this page and update the “Last updated” date. Where changes are material, we will provide additional notice as required by law (for example, in-app or by email).

15. Contact

If you have questions about this Privacy Policy or our data practices, contact us at info@americansweets.com or at the postal address in Section 1.
